Edmonton Workers Compensation Lawyers

Edmonton Workers' Compensation lawyers are the men and women lawyers of Edmonton that handle workers compensation cases for people that live in the Edmonton area, or where the employment injury happened in the Edmonton area but the injured person lives elsewhere. The legislation that governs the Workers Compensation system in Alberta is the Workers Compensation Act of Alberta.  There are also Workers Compensation Regulations that are important.  The whole program is run by the Workers' Compensation Board (WCB) of Alberta. 

The Workers Compensation Board (WCB) of Alberta is a not-for-profit corporation legislated to administer the workers compensation system for the province. Through the payment of premiums, employers fund this no-fault system that provides compensation for workplace injuries and occupational diseases to workers.

In Alberta, the majority of employers are required by law to have workers' compensation insurance for all of their workers, and must notify the WCB within 15 days of hiring their first worker. This includes full-time, part-time, temporary and casual staff, as well as family members providing a service for your business.

Workers' Compensation Employer Assessments
The Workers' Compensation Act contains a system for assessing and collecting premiums. Separate "experience accounts" are maintained for each employer in respect of assessments levied and costs of claims. An employer's assessment is based on a number of factors including industry classification, size of payroll and claims experience rating. Costs from an injury claim may increase the employer's experience account. The Act allows for credits or rebates to employers in certain situations and also for relieving the employers of claim costs in certain situations. The claim costs can be disputed but relieve is normally only granted in exceptional circumstances. Appeals from employer assessments can be made to the Appeals Commission of the Workers Compensation Board. Advice from qualified professionals is suggested.

Workers' compensation is a system that provides compensation for employees who are injured in the course of employment.  In exchange, the employee relinquishes the right to sue his or her employer for negligence.

Workers' compensation is a form of insurance.  The employer is required by law to carry this insurance and the insurance pays out to the employee (or their survivors i.e. family) in the event the employee is injured on the job or, in some cases, becomes ill due to circumstances surrounding their job.  This insurance generally covers the employee upon the employee becoming disabled, either temporarily or permanently, or if the employee dies.  The injury or illness must be an on the job injury or illness.

Not every case requires an injured person to have a workers' compensation lawyer on an on-going basis – but some do. Some of the more severe injuries do. Some appeals do.

In the event of a work-related injury the WCB may cover medical expenses, provide wage replacement and in some cases may cover rehabilitation services. The whole Workers' Compensation Act insurance or compensation scheme includes medical treatments and indeed this is a major component of the whole system.
